Terms&Conditions of Auction Participation intheauction (publicsale)– inperson, inwritingorbytelephone– isrealisedonthe basisofthesetermsandconditionsofauction.Thetermsandconditionsofauctionarepublished intheauctioncatalogue,onthe Internetand inclearlyvisiblepostingsonthepremisesofthe AuktionshausKauppGmbH.Byplacingabid,thebuyeracceptsthesetermsandconditionsof auctionasbinding. 1. Theauction iscarriedoutvoluntarilyonbehalfand foraccountof theclients.Thefigures in parentheses identify theownerand/orclient. 2. All objectssubmitted forauctionmaybe inspectedandchecked in the frameworkof theauction viewing.Theyareall usedwithoutexception. Inall cases, theactual stateof theobject tobeauctioned offat the timeofacceptanceshallbe theagreedquality in thesenseof thestatutoryprovisions.The descriptionsand informationcontained in thecatalogue, in thestatus reportor inexpertopinionsare alsoestimatesandconstitutenowarrantyasdefinedby§443BGB [CivilCode] for thequalityof the objectofart.Thesameshallapply to thepictures in thecatalogue.Thepurposeof thesepictures is to giveprospectivebuyersan ideaof theobject tobeauctionedoff; theyareneitherpartof theagreement onaqualitynorawarranty forquality.Thecataloguedescriptionsaredrawnupby theAuktionshaus KauppGmbH to thebestof theirknowledgeandbeliefandwithgreatcare. Incaseof interest, a condition report from theAuktionshausKauppGmbHcanbe requested foreachof theobjectsofart tobeauctionedoff.All objects tobeauctionedoffareusedandaresold to theexclusionofwarranty. Theexception to thisprovision isdamagearising from injuries to life, limborhealth incaseswhere a negligentviolationofdutyby theuseroradeliberateornegligentviolationofdutycommittedby a legal representativeorvicariousagentof theuser.Thecatalogue text in theGerman languageshall be binding.Theauctioneeracceptsno liability for faulty translationsof thecatalogue texts. 3. Damageclaimsagainst theAuktionshausKauppGmbH (hereinafter referred toas«auctioneer») basedondefectsof titleandmaterialdefectsandother legal reasons (incl. reimbursementofwasted expenditure) shallbeexcluded.Theexception to thisprovision isdamagearising from injuries to life, limborhealth incaseswhereanegligentviolationofdutyby theuseroradeliberateornegligent violationofdutycommittedbya legal representativeorvicariousagentof theuserandotherdamage arising fromgrosslynegligentviolationofdutyby theuseroradeliberateorgrosslynegligentviolation ofdutycommittedbya legal representativeorvicariousagentof theuserorasdeterminedbyproduct liability law. 3a. Books thatgetcalledupwerenotchecked forcompleteness. 4. Theauctioneerhas the right tooffer, combine, separateorwithdrawnumbersoutsideof theorderof thecatalogue. 5. Thebidof thehighestbidder shallbeaccepted ifnohigherbid ismadeafter thebidwascalledout three times.Theauctioneermay reserveor refuseacceptanceonbehalfof theclient. If severalpersons make thesamebidat thesame timeand ifnohigherbid ismadeafter itwascalledout three times, the decisionwillbemadebydrawing lots.Theauctioneer shall takebackacceptanceandoffer theobject onceagain ifabid thatwasvisiblymade in timewasoverlookedbymistake.Usuallybidsare increased in incrementsof 10%. 6. Acceptanceshall oblige thebuyer topayandaccept.Property in theobjectauctionedoffshall only pass to thebuyeraftercompletepaymentofall claimsof theauctioneer.Vis-à-vis theauctioneer, the buyermayonlyoffsetuncontestedor legallyestablishedclaims.The riskof incidental lossand incidental deteriorationof theobject shallbe transferred to thebuyeruponacceptance. 7. If the limitagreeduponwith theconsignor isnot reached, thebidshallbeacceptedunder reserve. However, thebid for the limit to thepublicshall remainvalid, and theobjectmayalsobesold toother prospectivebuyers if there isasubsequentbid for the limit. If this isnot thecase, thepreviousbidder willbe informed.Bidsacceptedunder reserveshallbebinding forbidders for sixweeks, butwithout obligation for theauctioneer. 8. Togetherwith theacceptanceprice, asurchargeof26%shallbepaid to theauctioneer, plus the statutoryvalueadded tax tobepaid for thesurcharge.The totalamount shallbecomedueandpayable uponacceptance incashorcheque (max. 1000€)withpresentationof thechequecardandavalid identitycard, creditcardswill notbeaccepted.Paymentsofnon-residentbuyerswhosubmitted their bids inwritingorby telephoneshallbecomepayablewithineightdaysafter the invoicedate. Anybankchargesshallbeat thebuyer’sexpense. 9. Defaultofpayment shall occur twoweeksafter the invoicedate. From theoccurrenceofdefault onwards, interest to theamountof 1%permonthshallbecomepayable for thepurchasepricewithout prejudice to furtherdamageclaims. If thebuyer is indefaultofpayment, theauctioneermay rescind thecontractafterhavingfixeda periodofgrace. In theeventof rescission, all rightsof thebuyer regarding thepurchasedobject shall be forfeited. In thiscase, theauctioneer shall have the right toclaimdamages to theamountof the lostcharge for theobjectauctionedoff (consignorcommissionandbuyer’spremium)aswellascosts incurred forcataloguepictures from thebuyer. Inaddition, thebuyer shallbe liable for transport, storageandauctioneeringexpensesuntil returnor repeatedsellingof theobjectbyauction. If theobject isauctionedoff in thenextauctionor theoneafter that, thebuyer shallbe liable inaddition forany shortfall inproceeds.Heshall notbeentitled tohigherproceeds. If theauctioneeroptionally requests performance, thebuyer shallbeobliged tomakeanadvancepayment in thecaseofdefault inpayment as faras thepurchasepricedueand thesurchargeareconcerned.Theauctioneer shall have the right toexcludehim/her from furtherbids in theauctionand topasshis/hernameandaddresson toother auctionhouses for thepurposeofbanninghim/her. 10. Thehandingoverofpurchasedobjectsand the issuingof invoices, inparticularduringor rightafter theauction,willbecarriedoutunder the reserve thatnomistakesweremade. 11. Thepurchasedobjectsshall onlybehandedover to thebuyeraftercompletesettlementofall claims of theauctionhouse. 12. Thebuyer shallpickup thepurchasedobjects 14daysafter thedateof invoiceat the latest. If thebuyer is indefaultwithpickup/acceptance, theauctioneer shall have the right toput theobject in storageathis/herexpenseand riskonhisor third-partypremises, and thebuyer shallalsopay thecosts foranynecessary insurance. If theauctioneerputs theobject instorageonhisownpremises, thebuyer shallpaya feeofup to8€plusstatutoryvat afteraperiodof 14 days for storage foreachobjectper day.Thebuyer shall have the right toshowproofof the fact that thecostswerenot incurredand/ornot incurred in thatamount. If thebuyer requests that thepurchasedobjectbeshipped tohim, thisshallbe doneat thebuyer’sexpenseand risk.Thecosts forpackaging, insuranceandshipment shallbeborneby thebuyer. Shipmentorderswill onlybecarriedout if theauctioneerwasgivenawrittenshipmentorder. 13. Writtenbidswillbeexecutedonbehalfof thebidder.Thepricewritten in thebid formshallbe deemed thehighestbid, bidsmayalsobeaccepted fora lowerprice.Bidder’sorderscanonlybe executed inabindingmanner if theyaresubmittedcompleted inblock lettersandonedaybefore the auctionstarts.Only thespecifiedcataloguenumberandnot the titleof theobject shallbebinding. 13a. Writtenbidsshallbebindingandcannotbe takenback. 14. Telephonebidderswillbecalledat theauctioneer’sexpensesbefore the respective item iscalled up ifawrittenorder for thatwassubmitted in time.Thiskindofordercanonlybeexecuted froma limit priceof250€onwards,with thebiddersundertaking toofferat least the limitprice.Nowarrantycanbe assumed for theestablishmentof the telephoneconnection. 15. The termsandconditionsofauctionshallapplymutatismutandisalso topost-auctionsalesor to discretionarysales. 16. TheplaceofperformanceshallbeSulzburg. If thebuyer isabusinessmanor ifhehasnodomestic placeofgeneral jurisdiction, theplaceof jurisdictionshallbeMüllheim/Baden.German lawshallbe applicable.TheunConventiononContracts for the InternationalSaleofGoodsshall notapply. Shouldoneor severalprovisionsof these termsandconditionsofauctionbeorbecome invalid, thevalidityof the remainingprovisionsshall remainunaffected thereof. TheEnglishversionofour termsandconditionsofauctionare for informationonly. Incaseofdoubt, theGerman text is legallybinding. 16a. In the relationshipwith theowner, thebuyerassumespaymentofhalf thestatutory resale rights fee (2%of thehammerprice). It shallbe indicatedseparately in the invoiceandbecomesduepursuant to§26, Section 1,UrhG [CopyrightAct] for salesoforiginalsofworksoffinearts thecopyrights forwhich havenot lapsedyet.
