Terms and Conditions for Consignors

1. The Consignor of auctioned items will receive the full amount stated after the last fall of the hammer, less an auction fee of 22 % plus statutory VAT.
If the Consignor cancels their contract, they must pay Auktionshaus Kaupp GmbH (hereinafter referred to as «Auctioneer») a fee of 30 % of the agreed limit price or 20 € for items without a limit. The same applies if the execution of the contract fails due to culpable breach of duty by the Consignor, in particular due to defects in the item. The Auctioneer reserves the right to claim higher damages. The Consignor reserves the right to prove that no damage has been incurred or that the damage is significantly lower than the flat-rate demanded with the fee.

2. The Auctioneer auctions as an agent on behalf of the Consignor.

3. The auction contract expires after three months. If it is not cancelled, it is renewed for 3 months at a time.

4. The lower limit prices are determined by mutual agreement. Bids below this limit may only be accepted subject to reservation and the Consignor's authorisation to sell must be obtained.

5. Unless otherwise agreed, the Consignor must collect the auction invoice in person. If the bid is accepted subject to reservation, the Consignor must notify their decision in writing in good time so that the bidder can be notified in the normal course of business.

6. If requested, the consigned items will be illustrated in the respective catalogue. Otherwise, unless stated differently, the catalogue illustration is at the discretion of the Auctioneer. The costs for the catalogue illustration (depending on size between 60 € and 180 € plus statutory VAT) are to be borne by the Consignor, even in the event of a non-sale. Further expenses, e.g. for restorations, cleaning costs (e.g. silver polishing) and appraisals will be charged according to expenditure or proof.
spacer 7. The Consignor is liable for information concerning the authenticity, origin and age of the objects consigned by them. The Auctioneer will be commissioned to insure the consigned items at the Consignor's expense. The premium for three months is 1 % of the limit or estimated price (plus statutory VAT). The Auctioneer is not liable, irrespective of the legal grounds, unless they are guilty of intent or gross negligence. This exclusion of liability also applies to the Auctioneer's vicarious agents.

8. Gold and silver items may be auctioned below market value.

9. If the items are not sold in the first auction, they may be sold in the post auction sale, provided that no redemption is made. For further auctions, the limit is automatically reduced by 50 %.

10. The respective catalogues or house lists, for which a nominal fee must be paid, serve as notification of the auction of consigned items.

11. Place of jurisdiction for both parties is the registered office of the auction house.

12. Non-auctioned items must be collected no later than 3 weeks after notification or a deadline set by the Auctioneer. After expiry of this period, further storage of the items is subject to a charge. Items that are not collected despite a reminder may be auctioned or sold by the Auctioneer without a limit after prior notice.

13. The Auctioneer will invoice the consignor approximately eight weeks after the auction.

14. For the valuation of items that are not auctioned, the Auctioneer will charge 3 % of the estimated price as well as the travelling costs incurred.

15. Transport costs are to be borne by the Consignor.
 
16. The Consignor agrees that in the case of sales subject to the German Copyright Act, his name and address will be disclosed to the collecting society VG-Bildkunst in Bonn upon request. If the Consignor wishes to maintain confidentiality, they undertake to pay the auctioneer a share of 5 % of the sales proceeds plus the statutory value added tax on this share, which the Auctioneer will then pay on their behalf.

17. The Consignor further assures that they have paid the relevant customs duties when importing or exporting the objects. In the case of items with technical functions, the Consignor assures that the existing components (e.g. mechanical and electrical) are in a roadworthy condition.
